4. Pricing & Payments

4.1 All prices displayed are in Indian Rupees (INR) and inclusive/exclusive of taxes as indicated.
4.2 The Company reserves the right to refuse or cancel orders for pricing errors.

5. Intellectual Property

5.1 All content on the Platform—including images, trademarks, designs, text, videos, and other materials—is the exclusive property of the Company or its licensors.
5.2 No content may be copied, reproduced, distributed, or exploited without prior written consent.

6. Third-Party Services

6.1 The Platform may integrate third-party logistics, payment gateways, or content.
6.2 The Company is not liable for actions or omissions of third-party service providers.

7. Limitation of Liability

7.1 To the fullest extent permitted by law, the Company shall not be liable for:
a. indirect, incidental, punitive, or consequential damages,
b. delays in delivery,
c. reliance on product information beyond what is provided on the Platform.
7.2 Maximum aggregate liability shall not exceed the amount paid by the User for the transaction giving rise to the claim.

8. Indemnification

You agree to indemnify and hold harmless the Company from any claims, losses, liabilities, damages, or expenses arising from your misuse of the Platform or violation of these Terms.

9. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Courts at [City, State] shall have exclusive jurisdiction.

10. Amendments

The Company may modify these Terms at any time. Continued use of the Platform constitutes acceptance of the revised Terms.

11. Additional Legal Terms & Liability Disclaimers

  • Right to Modify or Cancel: Bayhue Consumer Private Limited reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter, or modify this contest or any part thereof (including eligibility criteria and terms) at any time without prior notice. It shall be the sole responsibility of the participants to check the rules and regulations on the website.

  • Prize Entitlement & Substitutions: The participant(s) hereby agree(s) and confirm(s) that mere announcement/declaration of being selected as a participant will not entitle the participant to the prize. Prizes are non-transferable, non-exchangeable, and cannot be redeemed for cash or alternatives. Bayhue Consumer Private Limited reserves the right to substitute prizes of equal or equivalent value if necessary.

  • Limitation of Health & Personal Liability: Bayhue Consumer Private Limited is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, or mental trauma caused to the viewer/participant(s) in any manner whatsoever, in connection to the contest.

  • No Financial Reimbursements: Bayhue Consumer Private Limited shall in no manner reimburse/incur any cost, expense, or losses including but not limited to loss of employment opportunity, loss caused due to absence, etc. arising out of the participation in the contest and/or enjoyment of the prize, and the participant(s) shall solely bear/incur the same.

  • Indemnity & Waiver: Participants shall comply with these terms and conditions and waive any right to claim ambiguity in these terms and conditions and release, indemnify and hold harmless Bayhue Consumer Private Limited and their respective affiliates, advertising and promotion agencies, and their respective owners, agents, auditors, representatives, officers, directors and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind relating to, resulting from or arising from this program.

  • Finality of Decisions: All decisions made by Bayhue Consumer Private Limited shall be final and binding on all the viewers/participant(s) and in no event shall the viewer/participant(s) dispute the decision made by Bayhue Consumer Private Limited and/or its employees in connection with the same.

  • "As-Is" Information: Bayhue Consumer Private Limited is not responsible for any errors or omissions in the terms and conditions contained herein. The participants acknowledge that all information provided in the contest is provided "as is" without warranty of any kind.

  • Voluntary Participation: This contest is being made purely on a "best effort" basis and participating in this contest is voluntary. By participating in the contest, you will be legally bound hereby, to release from liability, and hold harmless Bayhue Consumer Private Limited, and any of its affiliates, employees or agents representing or related to Bayhue Consumer Private Limited and its services/products.

  • Governing Law & Jurisdiction: The terms of these rules and regulations shall be construed in accordance with the laws of India and in case of any dispute or any other matter arising in reference to the contest shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.
